Terms of service

The rules for using mothermade and booking a visit.

Draft for review by counsel. Not final legal text. Items in yellow brackets still need real answers.

Welcome

These terms govern your use of mothermade.health and the virtual lactation services we offer ("Services"). By using the site or booking a visit, you agree to them. If you do not agree, please do not use the Services.

Who can use mothermade

You must be at least 18 and located in a state where we provide Services [launch states]. You may book on behalf of your baby as their parent or legal guardian.

What we provide

mothermade connects you with IBCLCs for lactation support by video. Your IBCLC can watch a feed, coach latch and positioning, review pump setup, and build a plan. Video cannot replace a hands-on mouth exam or weighed feed. If you need in-person care, your IBCLC will tell you.

Not for emergencies. mothermade is not an emergency service and does not replace your doctor, pediatrician, or midwife. If you or your baby have an emergency, call 911. Our IBCLCs are lactation specialists. They do not replace medical diagnosis or treatment by a physician.

Booking, insurance, and payment

  • Benefits check: we check your insurance benefits before your visit and tell you what to expect. Coverage varies by plan and is not guaranteed.
  • Insurance visits: you are responsible for copays, deductibles, and any amount your plan does not cover.
  • Self-pay: [$149] per visit [confirm]. HSA and FSA cards are accepted. We provide a receipt you can submit to your plan.
  • Card on file: you are not charged to book. We keep a card on file for copays, no-shows, late cancellations, and the self-pay fee if insurance does not cover your session.
  • Cancellations and no-shows: [policy: notice window and fee amounts].
  • Refunds: [policy].

Telehealth

Visits are provided by video. Before your first visit you will be asked to review and accept our Telehealth Consent.

Your responsibilities

  • Give us accurate information about yourself, your baby, and your insurance.
  • Use a private space and a working device and connection for visits.
  • Do not record visits without permission [recording policy].
  • Treat our team respectfully. We may end a visit or the relationship if someone is abusive.

Acceptable use

Do not misuse the site: no unlawful activity, no attempts to break or access it without permission, no scraping, and no impersonating anyone.

Content and ownership

The mothermade name, site, and content belong to [Legal company name] or its licensors. You may use the site for personal, non-commercial purposes. Educational material on the site is general information, not medical advice for your situation.

Disclaimers

We work hard to provide good care, but we cannot guarantee particular results. The site and Services are provided "as is" and "as available" to the extent the law allows.

Limits on liability

To the extent the law allows, mothermade is not liable for indirect or consequential losses, and our total liability is limited to the amount you paid us in the 12 months before the claim [counsel to confirm and adapt to state law]. Nothing here limits liability that cannot legally be limited.

Disputes and governing law

These terms are governed by the laws of [state]. [Counsel: dispute resolution approach, for example informal resolution first, then arbitration or courts, and any class action waiver].

Changes and ending use

We may update these terms and will post the new version with its date. Continued use means you accept the update. You can stop using the Services at any time.
